Terms of Use

Please read through my terms of service to get a better idea of how I operate. If you don’t find the answer you’re looking for here be sure to contact me and I’ll get back with you as soon as possible.

  1. Quotes are valid for 30 days.
  2. All work is billed on a per project basis. Occasionally small work and maintenance may be billed at my hourly rate of $150.
  3. A non-refundable fee of 50% is required up front before beginning any work and the remaining 50% will be due upon completion of the project.
  4. Estimates are based on the information initially provided and may be subject to change if additional work is required.
  5. Changes requested beyond the original scope of the project will either be issued a new quote to sign off on or on agreement will be charged at our hourly rate of $150.
  6. Stock photography will be purchased from iStockphoto, and is limited to 10% or less of the project total cost. Otherwise, the you’re responsible for obtiaining the photography through your own means.
  7. Payment terms for invoices are strictly 10 days from date of invoice unless otherwise stated.
  8. Unpaid balances beyond 30 days will (at my discretion) attract a percentage based late payment fee (maximum of 5% per month), compounded and payable monthly, of the total outstanding balance.
  9. I check messages from all my communication methods twice a day, once at 10AM CST and the other at 2PM CST. Any contact made after 6pm will be returned the next business day unless you have an emergency.
  10. I don’t work weekends or major holidays. If overtime work is requested through these times, I may be able to help but the rate will be billed at $200 per hour.
  11. Logo/Branding consists of the unique design of a mark and/or name for the entity.
  12. Corporate identity consists of the digital design of a business card, letterhead, and envelope.
  13. Websites are designed to work with current technologies and browser versions. If future unforeseeable changes to technology or browsers cause website errors, I can repair these at my current hourly rate.
  14. I guarantee compatibility with Firefox 3 and above, Opera, Safari, and Internet Explorer 7 & 8.
  15. Plugins that are installed will be checked to the best of my ability that they are working properly, but if they malfunction later, I will not be held responsible. Make sure you fully test the site upon delivery.
  16. Quoted delivery dates may change due to delays in your response times or excessive design changes.
  17. No speculative work allowed.
  18. It is understood that I am an independent professional contracting firm and that I will not in any event be construed as or hold myself to be under direction of my customers. It is further agreed that at no time will any work efforts be under the supervision or control of you, although I agree to comply with all reasonable requests and regulations applicable to any other business invitation. It is also agreed that I, as an independent contracting firm, am not restricted to working exclusively for you during the term of the agreement.
  19. Ownership of the designs and development code remain my property until I am paid in full.
  20. I retain the right to use any designs for promotional purposes unless otherwise denoted in contract.
  21. Work that is refused by you, or remains unpaid will remain my property and cannot be used in whole or in part by you or your company.
  22. I will not be responsible for any damage, loss or liability you or any third party may suffer. This includes loss of revenue, profits or data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by me or otherwise.
  23. Either party may terminate the contract without cause upon thirty (30) days written notification to the other party. I may terminate this agreement immediately upon the refusal to, or inability to perform under the contract or a breach of the contract. Furthermore, the contract shall be terminated automatically in the event of our death. On termination of the contract, your obligation to pay me, except for services already accrued or incurred, will forthwith cease and terminate.
  24. The purchaser is deemed to have read and accepted these terms and conditions on receipt of payment.
  25. These Terms and Conditions supersede all previous representations, contracts, understandings or agreements, unless specifically agreed otherwise by both Parties, in writing.
  26. I reserve the right to revise these terms and conditions at any time.
